| By participating in the auction through any electronic means, you acknowledge that you have read and understood these terms and conditions and expressly agree to be bound by them. Participation constitutes full acceptance of these terms, which are final and legally binding. | من خلال المشاركة في المزاد بأي وسيلة إلكترونية، فإنك تقر بأنك قرأت هذه الشروط والأحكام وفهمتها وتوافق صراحةً على الالتزام بها. وتُعد المشاركة في المزاد قبولاً كاملاً لهذه الشروط والأحكام، والتي تكون نهائية وملزمة قانوناً. |
| Subject: Massar Solutions PJSC (the “Seller”) offers light and heavy vehicles and equipment for sale on an “as-is, where-is” basis, with all faults, defects and malfunctions, whether disclosed or undisclosed. No warranty, exchange, return or repair is provided, except for the limited chassis guarantee described in these Terms and Conditions. A formal failed inspection report issued by the Traffic Department due specifically to a chassis issue must be submitted within seventy-two (72) hours from the date of collection of the Vehicle and the relevant documents. For security reasons, Vehicles remain locked and may only be inspected externally. | Date and Time of Auction: The Auction will start and end on the dates and times specified on the auction website. | تاريخ ووقت المزاد: يبدأ المزاد وينتهي وفقاً للتاريخ والوقت المحددين على الموقع الإلكتروني للمزاد. |
| Inspection Site and Hours: Musaffah Industrial Area M12, Abu Dhabi (behind Nissan Showroom), seven days a week from 08:00 AM to 06:00 PM, with a break from 1:00 PM to 2:00 PM. Vehicle inspection is permitted only during the stated Auction period. | موقع ومواعيد المعاينة: منطقة مصفح الصناعية M12، أبوظبي (خلف معرض نيسان)، سبعة أيام في الأسبوع من الساعة 08:00 صباحاً حتى 06:00 مساءً، مع فترة استراحة من الساعة 1:00 ظهراً حتى 2:00 ظهراً. وتقتصر معاينة المركبات على فترة المزاد المعلنة. |
| Available Vehicles and Registration: Available Vehicles may be viewed without registration. To submit a bid, the Bidder must register on the auction website and create an account using a valid email address and password. The Seller reserves the right to approve, reject or cancel any registration without providing a reason. | المركبات المتاحة والتسجيل: يمكن الاطلاع على المركبات المتاحة دون تسجيل. ولتقديم مزايدة، يجب على العارض التسجيل في الموقع الإلكتروني للمزاد وإنشاء حساب باستخدام عنوان بريد إلكتروني صالح وكلمة مرور. ويحتفظ البائع بالحق في قبول أي تسجيل أو رفضه أو إلغائه دون إبداء سبب. |
| Bid Security: Each Bidder must provide a single AED 3,000 account activation deposit in accordance with Clause 4 below. | تأمين المزايدة: يجب على كل عارض تقديم وديعة واحدة بقيمة 3,000 درهم إماراتي لتفعيل الحساب وفقاً للبند 4 أدناه. |
| Required Documents: Companies must provide a valid trade licence and UAE VAT registration certificate. Individuals must provide a valid Emirates ID, passport or driving licence. Documents may be submitted to the Auction Office at Musaffah Industrial Area M12, Abu Dhabi, or through the communication channels made available by the Seller. | المستندات المطلوبة: يجب على الشركات تقديم رخصة تجارية سارية وشهادة تسجيل ضريبة القيمة المضافة في دولة الإمارات العربية المتحدة. ويجب على الأفراد تقديم بطاقة هوية إماراتية أو جواز سفر أو رخصة قيادة سارية. ويمكن تقديم المستندات إلى مكتب المزاد في منطقة مصفح الصناعية M12، أبوظبي، أو عبر وسائل التواصل التي يحددها البائع. |
| Bid Validity: Bids must remain valid for sixty (60) days from the submission date. | مدة صلاحية المزايدة: يجب أن تظل المزايدات سارية لمدة ستين (60) يوماً من تاريخ تقديمها. |

| VAT: All purchases are subject to VAT at the applicable rate, currently 5%, in accordance with the applicable laws and regulations of the UAE. | ضريبة القيمة المضافة: تخضع جميع المشتريات لضريبة القيمة المضافة بالنسبة المطبقة، والبالغة حالياً 5%، وفقاً للقوانين واللوائح المعمول بها في دولة الإمارات العربية المتحدة. |
| Auction Results: Auction results will be communicated to participating customers by SMS or email using their registered contact details. | نتائج المزاد: يتم إخطار العملاء المشاركين بنتائج المزاد عبر رسالة نصية قصيرة أو البريد الإلكتروني باستخدام بيانات الاتصال المسجلة لدى الشركة. |
| Vehicle Sales Documents: Sales documents will be issued within 20 to 25 business days after full payment has been credited to the Seller’s account. Documents will be issued only in the name of the registered Bidder. The Buyer bears all costs associated with ownership transfer. | مستندات بيع المركبة: تصدر مستندات البيع خلال 20 إلى 25 يوم عمل من تاريخ قيد كامل المبلغ المستحق في حساب البائع. ولا تصدر المستندات إلا باسم العارض المسجل. ويتحمل المشتري جميع التكاليف المرتبطة بنقل الملكية. |
| Buyer Fees: A sales fee of AED 500 and an ownership transfer fee of AED 450 apply to each awarded Vehicle. | رسوم المشتري: تطبق رسوم بيع قدرها 500 درهم إماراتي ورسوم نقل ملكية قدرها 450 درهماً إماراتياً على كل مركبة تمت ترسيتها. |
| Payment: The full amount due must be paid to the Seller’s official account within seven (7) business days of the Award Letter. Accepted payment methods are cash, personal cheque, company cheque, Manager’s Cheque and bank transfer. Payment must be made by the registered Bidder/account holder or an authorised representative under a signed payment authorisation letter. | الدفع: يجب سداد كامل المبلغ المستحق إلى الحساب الرسمي للبائع خلال سبعة (7) أيام عمل من تاريخ خطاب الترسية. وتشمل طرق الدفع المقبولة النقد، والشيك الشخصي، وشيك الشركة، وشيك المدير، والتحويل البنكي. ويجب أن يتم الدفع من قبل العارض المسجل/صاحب الحساب أو ممثله المفوض بموجب خطاب تفويض دفع موقع. |
| Vehicle Collection and Ownership Transfer: Vehicles will be released only after full payment has been received and verified by the Seller’s Finance Department and on the collection date communicated by the Seller. Collection hours are Monday to Friday, 08:00 AM to 04:00 PM. The Buyer must complete ownership transfer within 24 hours of receiving the transfer documents. Ownership transfer may be completed through the official online transfer module or via Taresh. The Vehicle must not be altered before title transfer is completed. | استلام المركبة ونقل الملكية: لا يتم تسليم المركبات إلا بعد استلام كامل المبلغ والتحقق منه من قبل الإدارة المالية لدى البائع، وفي تاريخ الاستلام الذي يحدده البائع. وتكون مواعيد الاستلام من يوم الاثنين إلى يوم الجمعة، من الساعة 08:00 صباحاً حتى 04:00 مساءً. ويجب على المشتري إتمام نقل ملكية المركبة خلال 24 ساعة من استلام مستندات نقل الملكية. ويمكن إتمام نقل الملكية من خلال خدمة نقل الملكية الإلكترونية الرسمية أو عبر خدمة «تارش» (Taresh). ولا يجوز إجراء أي تعديل على المركبة قبل إتمام نقل الملكية. |
| Parking Fees: Following completion of ownership transfer, the Buyer must collect the Vehicle within 24 hours. If the Vehicle is not collected within that period, a parking fee of AED 100 per day will apply. | Other Collection Conditions: Spare keys will be provided only if available, with no compensation if unavailable. All number plates will be removed before handover. | Bidder Responsibility: The Bidder is responsible for reviewing these Terms and Conditions, the Vehicle details and the bid price before submitting a bid and bears responsibility for any error in the bid. | مسؤولية العارض: يتحمل العارض مسؤولية مراجعة هذه الشروط والأحكام وبيانات المركبة وسعر المزايدة قبل تقديم المزايدة، كما يتحمل مسؤولية أي خطأ يرد في المزايدة. |
| Seller’s Rights: The Seller may accept or reject any bid or any part of a bid without providing a reason. | حقوق البائع: يحق للبائع قبول أو رفض أي مزايدة أو أي جزء منه دون إبداء سبب. |
| Company Property: The Seller may require the Buyer at any time to return any property or device belonging to the Seller that is found in a Vehicle, and the Buyer must promptly return such property or device. | ممتلكات الشركة: يحق للبائع مطالبة المشتري في أي وقت بإعادة أي ممتلكات أو أجهزة مملوكة للبائع يتم العثور عليها داخل المركبة، ويلتزم المشتري بإعادتها فوراً. |
| Failure to Pay on Time: If the total awarded amount is not paid within seven (7) business days of receipt of the Award Letter, the Bid Security Deposit will be forfeited and will not be refunded. The Seller may also award the Vehicle to another Bidder. | عدم السداد في الوقت المحدد: إذا لم يتم سداد إجمالي قيمة الترسية خلال سبعة (7) أيام عمل من تاريخ استلام خطاب الترسية، تتم مصادرة مبلغ تأمين المزايدة ولا يحق استرداده. كما يحق للبائع ترسية المركبة على عارض آخر. |

| 1.1. Massar Solutions PJSC (the “Seller”) offers light and heavy vehicles and equipment (each, a “Vehicle”) for sale through the online auction available at https://www.massarauctions.ae. By participating in the Auction through any electronic means, the participant acknowledges that it has read and understood these Terms and Conditions and expressly agrees to be bound by them. | 2. Vehicle Sale, Condition & Inspection | 2. بيع المركبة وحالتها ومعاينتها |
| 2.1. All Vehicles are sold strictly on an “as-is, where-is” basis, including all faults, defects and malfunctions, whether disclosed or undisclosed. No warranties of any kind are provided, and no exchange, return or repair will be accepted. The sole exception is the limited chassis guarantee set out in this Clause 2. | 2.1. تباع جميع المركبات حصراً على أساس “كما هي وفي مكانها”، بما في ذلك جميع العيوب والأعطال، سواء تم الإفصاح عنها أم لم يتم. ولا تقدم أي ضمانات من أي نوع، ولا يسمح بالاستبدال أو الإرجاع أو الإصلاح. والاستثناء الوحيد هو الضمان المحدود الخاص بهيكل المركبة (الشاصي) المبين في هذا البند 2. |
| 2.2. | 3.1. Bids must be submitted through the Massar Auction Portal at https://www.massarauctions.ae. Participants must create an account to submit a bid. | 3.1. يجب تقديم المزايدات من خلال بوابة مزاد مسار على الرابط https://www.massarauctions.ae، ويجب على المشاركين إنشاء حساب لتقديم مزايدة. |
| 3.2. | 3.4. Bidders must independently verify all information made available in relation to the Auction. | 4.2. | 4.3. Bidding is unavailable unless the Bidder’s account has an active Bid Security Deposit. | 4.5. By submitting the Bid Security Deposit and participating in the Auction, the participant agrees that the Seller may deposit and forfeit the Bid Security Deposit in the circumstances set out in Clauses 4.6 to 4.8. | 4.5. بتقديم تأمين المزايدة والمشاركة في المزاد، يوافق المشارك على حق البائع في إيداع ومصادرة تأمين المزايدة في الحالات المبينة في البنود 4.6 إلى 4.8. |
| 4.6. The bid is withdrawn during its validity period. | 4.6. إذا تم سحب المزايدة خلال مدة سريانه. |
| 4.7. The participant fails to complete the transaction within the specified period after the bid is awarded. | 4.7. إذا أخفق المشارك في إتمام الصفقة خلال المدة المحددة بعد ترسية المزايدة عليه. |
| 4.8. The participant enters a future Auction after the Bid Security Deposit has been forfeited without submitting a replacement deposit. | 4.8. إذا شارك المشارك في مزاد مستقبلي بعد مصادرة تأمين المزايدة دون تقديم تأمين بديل. |
| 4.9. Bid Security Deposits are refundable and a refund may be requested while logged in to the Massar Auction Portal. The Seller reserves the right to charge a refund service fee of AED 50. Auction Award: Subject to these Terms and Conditions, the Seller may award a Vehicle to the Bidder whose bid is determined to be the highest substantially responsive and compliant bid. | 5.1. ترسية المزاد: مع مراعاة هذه الشروط والأحكام، يجوز للبائع ترسية المركبة على العارض الذي يتبين أن عطاؤه هو أعلى مزايدة مستوفٍ للمتطلبات ومتوافق مع هذه الشروط والأحكام بصورة جوهرية. |

Auction Results Notification: Participating customers will receive notification of the Auction results by SMS or email using their registered contact details. | 5.2. إشعار نتائج المزاد: يتم إخطار العملاء المشاركين بنتائج المزاد عبر رسالة نصية قصيرة أو البريد الإلكتروني باستخدام بيانات الاتصال المسجلة لديهم. |
| 5.3. Vehicle Sales Documents: Sales documents will be issued within 20 to 25 business days after full payment has been credited to the Seller’s account. Documents will be issued only in the name of the registered Bidder. | 5.6. Payment Deadline and Methods: Full payment of the bid amount, Sales Fee, Ownership Transfer Fee and VAT must be made within seven (7) business days of receipt of the Award Letter. | 5.13. Ownership Transfer Process: The Bidder/Buyer must complete transfer of ownership of the Vehicle into its name within 24 hours of receiving the transfer documents from the Seller. Ownership transfer may be completed through the official online transfer module or via Taresh. The Bidder/Buyer must not alter the Vehicle in any way before title transfer is completed. | 5.14. Vehicle Collection & Parking Fees: Following completion of ownership transfer, the Buyer must collect the Vehicle within 24 hours. If the Vehicle is not collected within that period, a parking fee of AED 100 per day will apply. | 5.17. Odometer Readings: Odometer/kilometre readings are approximate and may vary from the actual reading. | 5.18. By registering on the Massar Auction Portal and participating in any Auction, the participant expressly acknowledges and agrees to these Terms and Conditions. No physical signature is required for acceptance. Electronic acceptance is valid, binding and enforceable in accordance with applicable law.
